Terms of Use

1. Who provides Novus Daily

Novus Daily is provided by Michael Holgate (“we”, “us”, “our”). Contact: support@thenovusapp.com.

2. Licence

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use Novus Daily on Apple devices that you own or control, for your own personal, non-commercial use.

3. Apple App Store EULA

Your use of Novus Daily is also subject to Apple’s standard end-user licence agreement (the “Apple EULA”), available at apple.com/legal/internet-services/itunes/dev/stdeula. In the event of any conflict between these Terms and the Apple EULA, the Apple EULA prevails to the extent of the conflict.

4. Novus Daily Pro subscriptions

Novus Daily offers an optional auto-renewing subscription, “Novus Daily Pro”, which unlocks premium themes, animations and customisations.

• Price: £2.49 per month or £24.99 per year (prices may vary by region).
• Billing: All payments are processed by Apple via your App Store account.
• Auto-renewal: Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
• Cancellation: Manage or cancel at any time via App Store → your profile → Subscriptions. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled by Apple in accordance with App Store policy.

5. Acceptable use

You agree not to: reverse-engineer or decompile Novus Daily except where law expressly permits; use Novus Daily to harass, harm or impersonate any person; or use Novus Daily in a way that violates any applicable law.

6. Not medical advice

Important.

Novus Daily is a self-help tool. It is not a medical device. It does not diagnose, treat, cure or prevent any condition, and it is not a substitute for advice from a qualified healthcare professional.

If you’re experiencing alcohol withdrawal symptoms, suicidal thoughts, or any other medical or mental-health crisis, contact your GP, NHS 111, A&E, or the Samaritans (116 123) immediately.

7. Intellectual property

Novus Daily, its branding, copy, design, icons, animations and code are owned by us or our licensors. Nothing in these Terms transfers any intellectual property rights to you.

8. Content you create

Any photos, notes or other content you add to the app are stored locally on your device. You retain all rights to that content. We have no access to it.

9. Disclaimers

To the maximum extent permitted by law, Novus Daily is provided “as is” without warranties of any kind. We do not warrant that Novus Daily will be uninterrupted or error-free.

10. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

Subject to the above, to the maximum extent permitted by law, our total liability arising out of or in connection with these Terms or your use of Novus Daily shall not exceed the greater of (a) the amount you have paid us for Novus Daily in the 12 months preceding the event giving rise to the liability, or (b) £20.

11. Changes

We may update these Terms from time to time. The “Last updated” date above shows when. Continued use of Novus Daily after changes means you accept the new Terms.

12. Termination

You may stop using Novus Daily at any time by deleting the app. We may suspend or terminate access if you materially breach these Terms.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your country of residence apply.
